Terms & Privacy
Hodly is operated by Hodler LLC, a Washington limited liability company referred to as Hodly, we, us, or our. These Terms of Use and Privacy Policy apply to www.hodlycrypto.com and any related Hodly website, application, wallet interface, analytics surface, account dashboard, or service collectively referred to as the Services.
1. Acceptance of Terms
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. We may update these Terms from time to time, and the updated version will be effective when posted unless a later effective date is stated.
2. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into these Terms. You are responsible for the accuracy of information you provide, the security of your account credentials, and all activity under your account. We may refuse, suspend, or terminate access where required by law, risk controls, partner requirements, or these Terms.
3. Non-Custodial Wallet Services
Hodly provides software, interfaces, analytics, and workflow tools for crypto users. Hodly is designed as a non-custodial service. Except where expressly stated, Hodly does not custody your fiat currency or digital assets, does not maintain a deposit account for you, and does not guarantee recovery of lost wallets, private keys, seed phrases, or incorrectly sent transactions.
You are responsible for reviewing wallet addresses, networks, token approvals, transaction details, gas fees, contract interactions, and confirmations before authorizing any action. Blockchain transactions may be irreversible once submitted.
4. Third-Party Ramp and Off-Ramp Providers
Hodly may make third-party fiat on-ramp and off-ramp services available so users can buy or sell supported digital assets. These providers may include MoonPay or other regulated payment and digital asset service providers where available. Such providers, not Hodly, are responsible for their own know-your-customer checks, sanctions screening, payment processing, transaction approval, limits, fees, refunds, chargebacks, and settlement.
A ramp provider may decline, delay, reverse, or limit a transaction based on its policies, compliance obligations, fraud controls, supported jurisdictions, payment method rules, or asset and network availability. Hodly does not control those decisions and is not responsible for a provider’s terms, privacy practices, pricing, exchange rates, fees, or service availability.
5. Accumulate, Automation, and User Instructions
Hodly may offer recurring, adaptive, or automated accumulation tools. When you enable an automated feature, you are instructing Hodly to act according to the plan parameters you choose, such as asset, wallet, amount, schedule, risk threshold, network, and applicable spend permission. You may be required to approve token permissions from your wallet before automation can run.
Hodly will not intentionally move assets outside the scope of your saved instruction and wallet-approved permission. You are responsible for monitoring active plans, maintaining sufficient balances and approvals, and pausing or disabling automation when you no longer want it to run. Automated actions may fail, skip, or execute later than expected due to network conditions, liquidity, provider availability, risk controls, gas sponsorship limits, or other operational issues.
6. Yield, DeFi, and Smart Contract Risk
Hodly may provide access to yield, vault, swap, portfolio, and other onchain workflows. Digital assets and DeFi protocols involve substantial risk, including market volatility, smart contract failure, oracle errors, liquidity constraints, protocol governance changes, liquidation risk, depegging risk, bridge risk, network outages, and loss of principal. Past performance, historical analytics, APY, risk scores, simulations, or backtests do not guarantee future results.
7. No Investment, Legal, Tax, or Financial Advice
Hodly provides software and informational tools only. Nothing in the Services is investment, legal, tax, accounting, financial, broker-dealer, or fiduciary advice. You are solely responsible for your decisions and should consult qualified professionals before making financial, legal, or tax decisions.
8. Prohibited Uses
You agree not to use the Services to:
- violate any law, regulation, sanctions rule, or third-party right;
- engage in fraud, money laundering, terrorist financing, or market abuse;
- submit false, misleading, or inaccurate information;
- attempt unauthorized access to Hodly, partner systems, wallets, or smart contracts;
- circumvent jurisdiction, compliance, rate-limit, entitlement, or payment controls;
- use the Services from a restricted jurisdiction or on behalf of a sanctioned person.
9. Subscriptions, Payments, and Fees
Hodly may offer free and paid plans. Subscription billing, renewals, cancellations, upgrades, downgrades, taxes, and receipts may be handled through third-party payment processors such as Stripe. Hodly subscription fees are separate from blockchain network fees, swap fees, vault fees, ramp provider fees, payment method fees, spread, or exchange-rate costs. Third-party ramp and off-ramp refunds or chargebacks are governed by the applicable provider terms.
10. Taxes
You are responsible for determining and paying any taxes that apply to your use of the Services, subscriptions, digital asset transactions, rewards, swaps, transfers, or gains and losses. Hodly does not provide tax advice.
11. Intellectual Property
The Services, content, design, software, trademarks, and related materials are owned by Hodly or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or commercially exploit the Services except as permitted by law or written agreement.
12. Disclaimers and Limitation of Liability
The Services are provided as-is and as available without warranties of any kind. Hodly does not guarantee uninterrupted access, error-free operation, asset availability, transaction completion, pricing accuracy, investment outcomes, or third-party provider performance. To the maximum extent permitted by law, Hodly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost assets, or business interruption.
13. Indemnity
You agree to indemnify and hold Hodly harmless from claims, losses, damages, liabilities, costs, and expenses arising from your use of the Services, your violation of these Terms, your violation of law, or your infringement of third-party rights.
14. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Unless otherwise required by law, disputes will be resolved in the state or federal courts located in Washington.

We may collect the following categories of information:
- account information, such as name, email address, profile details, and login data;
- contact and support information, including messages you send to us;
- wallet information, such as public wallet addresses, connected wallet metadata, network, and wallet type;
- transaction information, such as transaction hashes, token symbols, amounts, status, timestamps, and blockchain activity visible on public networks;
- subscription and billing metadata, such as plan, payment status, invoices, and processor identifiers;
- device, browser, log, cookie, analytics, approximate location, and IP address information;
- provider status information from third-party services, such as ramp transaction status, verification status, webhook events, and support identifiers.
2. Third-Party Identity, Payment, and Ramp Data
Third-party ramp, off-ramp, payment, wallet, and infrastructure providers may collect identity information, payment information, bank or card details, sanctions-screening information, wallet addresses, and transaction data directly from you. Hodly does not receive full card numbers, bank login credentials, or complete identity documents from those providers unless expressly disclosed. We may receive limited metadata needed to display status, provide support, prevent fraud, reconcile transactions, or comply with legal obligations.
3. How We Use Information
We use information to:
- provide, secure, maintain, and improve the Services;
- create accounts, authenticate users, and manage subscriptions;
- display wallet, portfolio, yield, swap, ramp, and automation status;
- process support requests and service communications;
- detect fraud, abuse, security incidents, and prohibited activity;
- comply with legal, tax, accounting, partner, and regulatory obligations;
- measure product performance and understand feature usage.
4. How We Share Information
We may share information with service providers, payment processors, ramp and off-ramp providers, wallet infrastructure providers, analytics providers, hosting providers, legal and compliance advisors, affiliates, and government or law-enforcement authorities where required or permitted by law. We may also share information in connection with a merger, financing, acquisition, reorganization, or sale of assets.
5. Cookies and Analytics
We may use cookies, local storage, pixels, and similar technologies to keep users signed in, remember preferences, secure sessions, measure performance, and improve the Services. Browser settings may allow you to block or delete cookies, but some features may not work correctly.
6. Blockchain Data
Public blockchain activity is generally visible to anyone and may remain available permanently. Hodly cannot delete or alter public blockchain records, transaction hashes, wallet addresses, smart contract events, or other data recorded on public networks.
7. Data Retention
We retain information for as long as needed to provide the Services, maintain business records, resolve disputes, enforce agreements, prevent fraud, meet partner requirements, and comply with legal, tax, accounting, and security obligations. Retention periods may vary based on the type of information and the reason it is kept.
8. Security
We use reasonable administrative, technical, and organizational measures designed to protect information. No system, wallet, smart contract, provider, or network can be guaranteed to be completely secure. You are responsible for safeguarding your credentials, devices, wallets, and transaction approvals.
9. Your Choices and Requests
You may contact us to request access, correction, deletion, or a copy of personal information associated with your account. We may need to verify your identity before completing a request, and we may retain information where permitted or required by law, security needs, fraud prevention, accounting, tax, dispute resolution, or partner obligations.
10. Children
The Services are not intended for children under 13, and crypto-related product features are intended for users who are at least 18. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us so we can review and delete it where appropriate.
11. International Users
Hodly is operated from the United States. If you access the Services from outside the United States, your information may be processed and stored in the United States or other jurisdictions where our service providers operate.
